Why act now
Non-compliance is penalized under Article 994 of the Federal Labor Law, with amounts calculated in UMAs, on top of the risk of having operations suspended.
The compliance grace period ended on June 17, 2025. Labor authorities are now authorized to verify compliance at any time.
Standing for a full shift causes varicose veins, chronic fatigue, and musculoskeletal injuries — which translate into absenteeism and turnover.
What the regulation requires
The law requires chairs with backrests that are safe and in proper condition, so standing staff can sit down whenever the task allows, without interrupting their duties.
This is the regulation's explicit requirement: a stool or bench isn't enough.
The chair must be right where the work happens, ready to use without interrupting the task.
Counter height for staff serving customers standing up; standard height for desk-level work.
The regulation lists this as preferred, not mandatory. It adds to overall comfort.

Frequently asked questions
The reform requires employers to make seats or chairs with backrests available to their staff. Mexico's Ministry of Labor and Social Welfare (STPS) is expected to issue additional technical criteria, but the core requirement is already clear: the furniture must genuinely support periodic rest and postural recovery during the workday.
The reform is aimed at the services and commerce sectors, along with comparable workplaces. It doesn't exempt other industries, such as manufacturing, wherever the nature of the work allows for it. We recommend a role-by-role assessment to determine where it applies.
No. Chairs must be available in the actual work area, not just in a separate break room, so staff can sit down whenever the task allows.
The reform to Mexico's Federal Labor Law was published in the Official Gazette of the Federation on December 19, 2024, and took effect on June 17, 2025. Labor authorities can now carry out inspections.
Non-compliance is penalized under Article 994 of the Federal Labor Law, with fines calculated in UMAs that can reach hundreds of thousands of pesos per worksite, on top of the risk of a suspension of operations. The exact amount depends on the current UMA value and the number of workers affected.
The regulation calls for enough chairs for the staff who work standing up, factoring in shifts and rotation. During our assessment, we calculate the right quantity per area so you don't overbuy or come up short.
